Kogi Guber: Court Clears Ajaka to Participate in APC Primary Election 

The High Court of the Federal Capital Territory, Abuja has cleared Murtala Yakubu Ajaka to contest the Kogi State Governorship primary election of the All Progressives Congress (APC).

ebirareporters.com recalls that an earlier Kogi High Court injunction had restrained Ajaka from the primary election.

The APC chieftain in response, filed a suit against the APC to stop the party from preventing his participation.

The suit with the number FCT/H/CV/2889/2023, also had a motion exparte no FCT/C/M/7115/202 which Justice M. Muazu has granted.

Justice Muazu ordered that:

COURT ORDER

Upon hearing S. E. ARUWA, SAN, with E. Omaga, Esq., and D. E Akori, Esq., Counsels for the Claimant/Applicant moved Motion Exparte No. M/7115/2023 dated 05/04/2023, and filed on the same day in the registry of this Honourable Court. And after meticulously reading through the affidavit in support and Written Address of Counsel:

IT IS HEREBY ORDERED AS FOLLOWS:

1. AN ORDER OF INTERIM INJUNCTION is granted restraining the Defendant/Respondent either by itself, agents, privies. staff and representatives from acting upon or giving effect to the purported suspension of the Claimant/Applicant as a member of the Respondent’s by the Ajaka Ward Executive Committee of the Defendant/Respondent of Igalamela/Odolu Local Goverment Area, Kogi State contained in the letter dated 20th March 2023 and excluding or refusing the claimant/Applicant from participating in the Defendant/Respondent’s Kogi State Primary election slated to hold on the 10% April, 2023 or such other date as may be fixed by the Defendant/Respondent pending the hearing and determination of he Motion on Notice filed in this Suit.

 

2. Matter is adjourned to 17/04/2023 for hearing of motion on Notice ”
